CDIB previously filed a complaint in the Supreme Court of the State of
New York against Morgan Stanley (“MS”) in regards to CDIB’s investment
in Stack 2006-1 CDO Supersenior Swap. CDIB and MS have now reached a
settlement on the dispute through mediation. The details of the
settlement are confidential and will not be disclosed.
